YOUR CREDIT CAN BE IMPROVED

YOUR PROPERTY IS MOSTLY PROTECTED

In Chapter 7 bankruptcy, "Liquidation," the government trustee looks for excess property to sell and pay the creditors. Real property up to $150,000.00 in equity (market value less mortgage liens) and most personal property, however, is protected. Valuable artwork, luxury vehicles, unworn designer clothing, if owned outright are not protected in bankruptcy.

Prior to the financial crisis, people filing Chapter 7 bankruptcy always received numerous credit card offers as soon as their case was over. Now, the banks hardly give anyone new credit. People often ask: "is my credit ruined for 10 years?" This is not true; your credit will improve as soon as you start working and earning. The 10-year period refers to a reform law passed in the 1970s, requiring the credit reporting agencies to remove the bankruptcy from you report after 10 years. By that time you'll be rich!

Creditors frequently send you bills, call you at home, and may seriously harass you. As Soon as you file a bankruptcy petition, a federal court order goes into effect, preventing anyone from trying to collect debts from you. If they continue to harass, or even contact you for their claim, after the case is filed, they can be sanctioned by the Court.
